I have a speeding ticket in a construction zone but the cop wrote the wrong date and color of vehicle?
I was given a speeding ticket in Georgia, 76 in a 50 construction zone, the cop wrote 2010 instead of 2009 and also the color of the vehicle is wrong plus the speed limit was about to change where he ticketed me to 70 mph, do i stand a chance of wining the case?
There is no legal requirement to dismiss a ticket due to error. The ticket can be amended at any time.
I have seen tickets dismissed due to error on rare occasions, but that is a matter of the judge's discretion, and not a matter of the law. In those cases, the error relates directly to the offense. The color of your car is insignificant to the offense, and the date can easily be explained due to the fact it has not occurred yet.
The fact the speed limit was "about to change" will not be considered by the court, especially in a construction zone.
